OS DIREITOS DE PROPRIEDADE COMO INSTITUIÇÃO PARA O DESENVOLVIMENTO DEMOCRÁTICO

O artigo mapeia algumas propostas de reconfiguração institucional dos direitos de propriedade. Primeiramente, conceitua a propriedade como uma instituição e analisa o contraste entre formas de propriedade pública e privada, individual e coletiva. A seguir, apresenta os desenhos institucionais da propriedade apregoados historicamente por doutrinas liberais e socialdemocratas. Finalmente, contrasta as propostas de John Rawls e Roberto Mangabeira Unger para o redesenho de uma economia de mercado democratizada. O trabalho ilustra, assim, a indeterminação institucional dos direitos de propriedade e a possibilidade de reconfigurá-los em vista de políticas desenvolvimentistas.
