The CONVENTIONALIZED CONSTITUTIONAL STATE
DELIMITATING A NEW THEORETICAL HORIZON IN THE INTERACTION BETWEEN INTERNAL LAW AND INTERNATIONAL HUMAN RIGHTS LAW

Basead on the perspective that the monism-dualism dichotomy has become insufficient to guide the current multilevel regime of protection of human rights, this article seeks to delimitate a new theoretical horizon for the relationship between domestic law and international law, having as its paradigm the Conventional Constitutional State, which is continuously reoxygenated by international human rights law. Therefore, it seeks, by the deductive method and through a bibliographic review, to analyze the main assumptions of monist and dualist theories, to identify the changes related to the State action in the international field that justify the overcome of such theories and to establish a starting point, based on contemporary pluralist theories, for a harmonious coexistence between State and international orders. In the end, it concludes that the new theoretical horizon, which replaces the monist and dualist proposals, must be grounded on heterarchical pluralism and the dialogue based on cooperation, alterity and the maximization of the protection of human rights.
