THE DATING CONTRACT AND THE CONSTITUTIONAL PRINCIPLES OF FAMILY LAW

The dating contract is a new type of contract, in which the contractors express thedesire to maintain a loving relationship with each other known as "dating." This work aims tostudy the validity of the legal business, based on the analysis of the constitutional principlesapplicable to family law, the social scene and the current doctrinal positions on the topic.After the study of the historical evolution of family law, of the constitutionalization of thecivil law, the common-law marriage, and the dating contract based on the constitutionalprinciples governing family law, we concluded that the dating contract can not be considerednull plan, that must be ponderation of the magistrate about the validity of the contract on thecase, taking into consideration the will of the parties.Published
