Resumo
O artigo examina a assim chamada violação eficiente do direito, formulação teórica situada no campo da Análise Econômica do Direito. Extrai-se da análise de textos selecionadas de Coase, Birmingham e Posner que há algo de convergente entre esta teoria e a crítica marxista ao direito, especialmente no que se refere à percepção do caráter adeontológico do fenômeno jurídico. A proposta consiste, em suma, no confronto entre estas duas perspectivas.

Abstract
The article examines the so-called efficient breach theory, a formulation located in Law and Economics field. It extracts from the analysis of selected texts by Coase, Birmingham and Posner that there is something convergent between this theory and the Marxist critique of law, especially with regard to the perception of the non-normative character of the legal phenomenon. The proposal, in short, consists of confronting these two perspectives.
