Resumo
O texto aborda o impacto do proibicionismo na política criminal de drogas em perspectiva comparada, a partir da análise da legislação penal de dois Estados latino-americanos: o Brasil e o México. Ao fazê-lo, demonstra que o Estado mexicano trouxe progressos significativos, especialmente pela adoção de critérios objetivos de diferenciação das figuras delitivas, um inegável avanço se comparado à legislação brasileira que trada da matéria.

Abstract
The text approaches the impact of prohibitionism in the criminal drug policy in comparative perspective, since the analysis of the criminal law of two Latin-American states: Brazil and Mexico. We can conclude that the Mexican state brought significant progresses, especially by the adoption of objective criteria of differentiation of the delusional figures, an undeniable progress comparing to Brazilian law that deals with the subject..
