Resumo

O presente artigo tem por objetivo investigar, a partir da crítica jurídica marxista, os limites ontológicos da Justiça do Trabalho. Coloca-se em debate a repetição da forma-valor na instância jurisdicional, indicando-se que existe na Justiça do Trabalho uma redundância da exploração capitalista que, apesar de não implicar a negação do uso tático da mesma instituição, não comporta em si a própria superação.

Abstract

This article aims to investigate, from the marxist juridical critic, the ontological limits of the Labor Justice.  The value form repetition in the jurisdictional field is discussed, pointing the redundancy of the capitalist exploration at the Labor Justice which, although does not deny its tactical use, can not fit at itself its own overcoming.
