Resumo
Este artigo reflete sobre a questão proposta por Boaventura de Sousa Santos (2003b): “Poderá o direito ser emancipatório?” Pensamos que o direito e as instituições estatais, aqui compreendido o Poder Judiciário, são campos hegemonicamente impregnados pela lógica neoliberal, mas que também apresentam contradições. Assim, buscaremos analisar os usos contra-hegemônicos do direito no campo jurídico e político, especialmente nos casos que envolvem reconhecimento de identidades de povos tradicionais para o reconhecimento de territórios.

Abstract
This article analyses the question proposed by Boaventura de Sousa Santos (2003b): “Can law be emancipatory?” We believe that law and legal institutions, including Judiciary, are hegemonically saturated fields by neoliberal logic, but they also have contradictions. So we will examine the counter-hegemonic uses of law in the legal and political field, especially in cases involving recognition of identities of traditional people to recognize their territories.
