Resumo: o artigo aborda a resistência do Supremo Tribunal Federal em realizar o chamado diálogo de Cortes, ou seja, de analisar e considerar a jurisprudência internacional em matéria de direitos humanos quando do julgamento de casos paradigmáticos. Com base na teoria do duplo controle ou crivo dos direitos humanos, pretende-se demonstrar que, no âmbito do julgamento da ADPF n. 153, o STF desconsiderou os compromissos internacionais assumidos em matéria de direitos humanos, reiterando sua postura nacionalista.

Abstract
This article takes on board the resistance of the Brazilian Supreme Court in realizing the dialogue between courts, for say, analyzing and considering the international judicial decisions in matter of human rights when judging paradigmatic cases. Based on the human rights double control theory, it intends to demonstrate that, during the legal trial of the ADPF n. 153, by avoiding to considerate the international commitments in terms of human rights, the Federal Court maintained its nationalist posture.
