Resumo
Este artigo analisa o constitucionalismo latino-americano e seu caráter anticolonial no nascedouro dos Estados Nacionais do continente. Para tanto, busca descrever as contradições sociais existentes no momento das independências, no começo do século XIX. Estuda o caráter do constitucionalismo latino-americano, utilizando exemplos das repúblicas do Haiti e do Paraguai e conclui com as dificuldades de sua implantação, que se mantém até hoje.

Abstract
This article analyze Latin American constitutionalism and its anticolonial character in the birth of the continent's national states. For that seek to describe the existing social contradictions at the time of independence, the early nineteenth century. Article studies the character of Latin American constitutionalism using examples from the Republics of Haiti and Paraguay and conclude with the difficulties of its implementation, which continues to this day.
