Resumo
Este artigo busca problematizar a tensa relação entre Estado de Direito e Democracia. O desenvolvimento do argumento a ser defendido passa pela necessária consideração da presença do conflito como elemento central dos regimes democráticos, a despeito da tentativa de escamoteamento do mesmo pela tradição liberal ainda hoje hegemônica no pensamento político. Estabelecer as relações entre Estado, Direito, capitalismo e democracia, bem como apontar o sujeito destacado dos conflitos que vicejam na sociedade contemporânea é a pretensão deste texto acadêmico.

Abstract
This article seeks to problematize the tense relationship between the rule of law and democracy. The development of the argument to be defended requires the necessary consideration of the presence of conflict as a central element of democratic regimes, despite the attempt to conceal it by the liberal tradition still today hegemonic in political thought. Establishing relations between state, law, capitalism and democracy, as well as pointing out the outstanding subject of the conflicts that flourish in contemporary society is the pretension of this academic text.Keywords: Rule of Law; Democracy; Social Conflict.
