Resumo

A partir da análise imanente, elaborada pelo filósofo José Chasin, a partir de Marx e dos apontamentos de György Lukács presentes em A destruição da razão, procuraremos analisar as determinações da obra História e consciência de Classe, de Lukács. Tratar-se-á de buscar explicitar a função do Direito no referido texto, tendo em conta o cenário posterior à vitória da Revolução russa. Temos por objetivo mostrar que a leitura lukacsiana sobre a esfera jurídica, em tal obra, deve muito às análises de Max Weber ao mesmo tempo em que incorpora elementos essenciais do marxismo. Como resultado, tem-se que a obra mais famosa do marxismo húngaro, também no que toca o Direito, somente pode ser compreendida em meio à função concreta que exerce na situação em que, ao mesmo tempo, tem-se uma revolução que triunfou, e que é tomada como parâmetro pelo marxista húngaro. Isto leva o autor húngaro a uma posição em que, simultaneamente, critica o Direito (buscando, tal qual Marx e Engels, o seu fenecimento) e defende a criação de uma ordem jurídica socialista, em que a centralidade do partido comunista, ao fim, é essencial.

Abstract

Having as a departing point, the immanent analysis elaborated by the philosopher José Chasin from Marx and from the notes of György Lukacs present in The Destruction of Reason, we will analyze the determinations of Lukacs' Historia History and Class Consciousness. The main objective of this article is to clarify the role of law in this text, taking into account the scenario after the victory of the Russian Revolution. We aim to show that the Lukacsian reading of the legal sphere in such a work owes much to Max Weber's analysis while incorporating essential elements of Marxism. As a result, we can see that the most famous work of Hungarian Marxism, also with regard to Law, can only be understood in the context of the concrete function it exercises in the situation in which, at the same time, there is a revolution that has triumphed, and that is defended by Lukács. This leads the Hungarian author to a position in which he simultaneously criticizes the law (seeking, like Marx and Engels, its demise) and defends the creation of a socialist legal order, in which the Communist Party is central.
