This work, under the legal-sociological methodology, questions who is the epistemic subject of the actions judged by the STF regarding the rights of trans people. The hypothesis is that, after strategic litigation at the Brazilian Federal Supreme Court, there is a new paradigm that formally recognizes trans people as subjects within diversity. The work is justified by the need to seek the protection of minorities within the Democratic Rule of Law and to understand the role played by legal institutions. The conclusion confirms the inaugural hypothesis.
