THE SYSTEM OF PRECEDENTS IN THE BRAZILIAN CODE OF CIVIL PROCEDURE: CONSTITUTIONAL BASIS AND CRITICAL POINTS OF ITS RECEPTION IN BRAZIL

From the 2015 Brazilian Code of Civil Procedure, a procedure for binding judicial decisions was inserted in the Brazilian legal system, which has been called, by the doctrine, as a precedent system. In general, the judges must observe precedents and summaries, in the form disciplined by article 927 of the procedural diploma. There was a clear influence of the common law in the construction of the systematic, which demands the understanding of institutes proper to Common Law. Equally relevant, especially in Brazil, the distinction between precedent and summary. Therefore, in addition to the rescue of fundamental common law legal institutes, we seek to identify a constitutional justification for decision-making standards in Brazil, based on the principles of equality and legal certainty. Afterwards, central provisions of the Code of Civil Procedure regarding the proposed study were examined, showing that a non-interpretive stance of jurists can undermine the very founding principles of the precedent system.Downloads
