Os OS LIMITES JURISDICIONAIS DO JUIZ DAS GARANTIAS NO PROCESSO PENAL BRASILEIRO

This article aims to understand in which sphere of activity in the Brazilian criminal procedure the so-called judge of guarantees was located, whose rubric was inserted in article 3º-A to 3º-F, of Decree-Law nº 3.689/41 (Code of Criminal Procedure – CPP) as amended by Law nº 13.964/19. The reserch problem emerge in articles 3-A, XIV and 3-C, caput, both of the CPP, because in these the legislator asserted that the powers of the judge of guarantees would end with the receipt of the formal accusation, pursuant to article 399 of the CPP. As the receipt of the exordial accusatory implies a typically jurisdictional act, including the possibility of summary acquittal pursuant to article 397 of the CPP, then it seems that the legislator attributed typical functions of the natural judge (Article 5º, LII, of the Federal Constitution) to a judge designed only to act in the phase of the preliminary inquisitive investigation. With the trial of the Direct Actions of Unconstitutionality nº 6298, 6299, 6300 and 6305 by the Supreme Court, there was recognition of a legistic error in relation to the content of the articles studied and an interpretation was given according to the Constitution to establish that the competences of the judge of guarantees end with the offer of the formal accusation. The theoretical framework adopted based on Foucaultian’s discourse analysis; and this work is done by using the inductive method, with the use of documents and literature review. This works concludes that the judge of guarantees has no jurisdictional function and cannot decide any matter relevant after the formal accusation, being only existing for the judicial control of collect evidente in the inquisitorial phase of the preliminary criminal investigation.
