A A DECADE OF THE CIVIL PROCEDURE CODE: PROGRESS AND/OR REGRESS IN THE FORMATION OF JUDICIAL PRECEDENTS

This study intends to analyze the system of precedents established in the Brazilian legal framework on the ten-year anniversary of the entry into force of the 2015 Code of Civil Procedure. It clearly brings the Brazilian civil law system closer to the common law systems, in which judges are granted greater powers in the adjudication of certain cases, especially regarding attributing enhanced effectiveness to specific decisions or binding force to precedents. The concept of precedent is examined, with a proper distinction made between precedents, case law (jurisprudence), and judicial decisions in general (which do not carry binding force). Furthermore, the concepts of ratio decidendi and obiter dictum are explored, along with the techniques used for confronting and overcoming precedents, such as distinguishing, overruling, and overriding. Finally, the study addresses the consolidation of the institutional strengthening of the Judiciary itself, the stability of the law, the security of legal relations, and the trust conveyed to litigants, as derived from the precedent system established by the 2015 CPC, thus upholding both constitutional and sub-constitutional principles and norms.Downloads
