MEDIAÇÃO ADMINISTRATIVA EM LITÍGIOS COLETIVOS SOBRE POLÍTICAS PÚBLICAS: POSSIBILIDADES E LIMITES DO CONTROLE A PARTIR DE UM ESTUDO DE CASO NO CAMPO DO DIREITO EDUCACIONAL DO ESTADO DO RIO DE JANEIRO

This paper carries out a case study on the use of administrative mediation in resolving collective disputes involving the state and the control of public policies. Its aim is to discuss the challenges involved in the use of administrative mediation by identifying certain dimensions that make the case studied paradigmatic and allow for the exploration of lessons learned and reflections applicable to other situations. The case studied involves the use of administrative mediation during a public civil action filed against the state of Rio de Janeiro involving the control of an educational policy. The main dimensions of analysis, based on the structural character of the litigation, are the specific nature of litigation involving the state, especially from the perspective of its procedural prerogatives, and the challenges arising from the perception that the control of public policies cannot disregard the fact that they result from a delicate articulation of actors and resources through a legal-institutional arrangement, which can be impacted. The delimitation of these dimensions of analysis will be based on a bibliographical review and the case study will be based on an empirical study methodology based on the articulation between the contextual elements, the delimitation of the case itself based on the data obtained and the discussion of the material based on the analytical dimensions previously worked on. As a result, we present a discussion about the possibilities and limits of such model in relation to collective litigation over public policies.
