Abstract

This text aims to present brief considerations on the widely proclaimed approximation of the civil law and common law families, especially due to the increase in legislative production in the countries of this family and the internalization of systems that value precedents by countries that have civil law as their legal system. Therefore, the goal of this work is to investigate whether there are indeed transplants or migrations occurring, taking Brazil and common law countries, especially the United States and England, as a perspective for comparison.

MBA em Gestão Estratégica de Pessoas pela UNIRITTER. Bacharel em Direito pela Pontifícia Universidade Católica do Rio Grande do Sul – PUCRS. Advogado concursado da Caixa Econômica Federal. Atualmente é Gerente Nacional de Tribunais Superiores.

Luiz Guilherme Pennacchi Dellore, Universidade Presbiteriana Mackenzie

Doutor e mestre em Direito Processual pela USP. Mestre em Direito Constitucional pela PUC/SP. Visiting Scholar (pós-doutorado) na Syracuse University e Cornell University (EUA). Professor de Direito Processual do Mackenzie, do IBMEC e da Escola Paulista do Direito. Advogado concursado da Caixa Econômica Federal. Ex-assessor de ministro do STJ. Membro do IBDP (Instituto Brasileiro de Direito Processual), IIDP (Instituto Ibero-americano de Derecho Procesal). Diretor do Ceapro (Centro de Estudos Avançados de Processo).
