Abstract

This article analyzes the system of binding to higher decisions of the Brazilian Civil Procedure Code. Despite the effort of the legislator, the establishment of a list of supposedly mandatory decisions (art. 927) and the scope of binding these decision-making standards still give rise to doubts and controversies. In this context, the study proposes to analyze some of the reasons for the reform and the regulation chosen in the code, to expose, from the doctrine and the comparison of decisions of the Federal Supreme Court, that the notion of precedent is qualitative. As a result, it is pointed out the impossibility of seeing the list chosen by the legislator as exhaustive for mandatory decisions, as well as it is concluded that it is possible to distinguish judicial products between legal theses and precedents, with different binding elements, that can occur in any decision of the Supreme Court, both of which can be seen as clarifying formulas of the current law, with mandatory effectiveness in the Judiciary.
