Abstract

This paper analyses what are the parameters adopted for the judgment of intervention orders by one Appel Court in Brazil (TJDFT) and to evaluate the adequate incorporation of the protective guidelines of the Maria da Penha Law. It is a quantitative-qualitative study with the analysis of 70 judgments handed down between 2013 and 2019. The results indicate a high number of appeals concentrated in few courts, mistaken use of the concept of gender-based violence, the creation of extra-legal criteria to denial protection requests, tolerance of short-term protection orders and case law inconsistency. There is a lack of uniform incorporation of the gender perspective.
