O CASO LAFLER VS COOPER E A RECEPÇÃO DAS SOLUÇÕES NEGOCIADAS NA JUSTIÇA CRIMINAL BRASILEIRA

The paper discusses the use of the Plea Bargain into the Brazilian criminal justice system, bringing up issues faced by the United States Supreme Court regarding the applicability of the institute. It was analyzed the Lafler v. Case. Cooper for being a case with dissenting votes and for illustrating the risks of the introduction of the bargain for the criminal process. However, other cases are also part of this research in anticipation of possible problems that should be faced by the Brazilian’s Law-Court system when incorporated into the national legal system solutions similar to that which was in 2019.
