Abstract

This paper approaches the judge of guarantees, introduced in the Criminal Procedure Code by Law nº 13.964/2019, from a consequentialist analysis. The objective is to demonstrate the importance of ex ante examination of the legal and economic consequences that can arise from the legal provision of an institute. As a result of the research, it is possible to infer, although the judge of guarantees is relevant to the accusatory system, its operationalization has not yet occurred due to obstacles, such as the lack of budget forecast, which could have been anticipated. Finally, the research was developed from the hypothetical-deductive approach method, concluding by the confirmation of the hypothesis that an ex ante consequentialist analysis could have avoided certain problems and difficulties in the implementation of the institute in Brazil.
