A POSSIBILIDADE DE ANTECIPAÇÃO E ESTABILIZAÇÃO DE TUTELA NAS DEMANDAS DECLARATÓRIAS E CONSTITUTIVAS

The present article aims to analyze the possibility of interim protection and stabilization of the preliminary injunctive relief on declaratory and constitutive judgements, after the enactment of the Civil Procedure Code of 2015. This, through a deductive-analytical methodology, based on bibliographical research, it is shown the main characteristics of the new system of interim protections in the Brazilian legal order. After that, the preliminary injunctive relief is analyzed, focusing on its stabilization. Finally, it is sought to verify the possibility of advancing the effects of the relief on the declaratory and constitutive judgements and its eventual stabilization, as well as the existence of any kind of utility of using this institute on those cases.
