Abstract

In the present article, the aspects of testimonial evidence, in brazilian forensic practice, are analyzed, focusing on the witness's commitment to tell the truth. The methodology used is qualitative and with data collection based on the participant observation technique. It appears that, despite the Civil Procedure Act establishing a procedure for the production of testimonial evidence, it is mechanically adopted, so that the witness does not effectively commit to telling the truth. Based on the model of honesty and the “fudge factor theory”, coined by psychologist Dan Ariely, some mechanisms that can reinforce the validity of testimonial evidence are presented, outlining some guidelines that can influence the witness bindingness to tell the truth. Finally, it is recommended that a specific methodology for the witness´s commitment be carried out in writing and with expressed vocalization by the witness, reducing the application of the “fudge factor theory”.
