O PROCESSO CIVIL E OS SEUS DESAFIOS NO CONTEXTO DO NEOCONSTITUCIONALISMO TEÓRICO

The objective of the article is to analyze some issues that revolve around the Civil Procedure in the current context of theoretical Neoconstitutionalism. For this, the semantic agreement about this neoconstitutionalism, its influence on the Civil Procedure and what are the current challenges to be faced regarding the legitimacy of the jurisdictional decision (the problem of judicial activism), respecting precedents, the Theory General Civil Procedure, the balance between fundamental rights and duties, the excessive constitutionalization of the legal system and human dignity. In the end, the concrete existence of numerous challenges for the interpretation and application of the Brazilian Civil Procedure is concluded, which starts to demand from the operators of the law the removal of their masks so that legitimacy can be granted through an effective and democratic participation in the jurisdictional task. This article adopts a qualitative perspective with an emphasis on bibliographical methodology, with an eminently theoretical approach.
