Abstract

The article analyzes the possibility of binding judicial precedents on arbitration awards in the Brazilian justice system. Its main objective was to study the institutes of arbitration, one of the methods of the multi-door justice system, and judicial precedents, one of the elements of the system of unification of jurisprudence. It also investigated whether arbitration must necessarily follow the understanding of precedents. The main result of the research was the observation that there is no specific legal provision requiring this. However, the doctrine, through the study of the entirety of the justice system, which includes judicial and extrajudicial activities, understands that binding is indispensable for the unity and effectiveness of conflict resolution, under the aegis of the CPC/2015.
