JURISPRUDENTIAL LAW, GEOJURISPRUDENCE AND VECTORS OF GLOBALIZATION: A FEW DIALOGUES BETWEEN LAW AND GEOGRAPHY

This article aims to discuss the notion of geojurisprudence. The context is centered in the term was coined in 1928 by Manfred Langshans-Ratzeburg. This author made texts reference to what we know as geojurisprudence. The objective here, however, it is pay more attention investigating some interactions between geographic space and the judicial models, analyzing how the geographic elements influence in the decision and hermeneutic aspects in the jurisdictional exercise. In this sense, the methodology reunites expedients like narrative literature review, inductive reasoning and qualitative guidelines of research. As main results, we enlist: (i) the cultural movements caused by geojurisprudence, their intensification in the globalized scenario and the inter-influences between globalized and localized cultural perceptions, in order to reveal the aspirations for cultural management and diversity presented by the interpreter (ii) the perceptions of the international community and how the judge assimilates them in the decision-making process, in order to reveal diplomatic aspirations (iii) the creation of economic spaces by business and market networks, especially considering the different jurisdictions. Here, seven possible concepts of geojurisprudence are listed as main conclusions.Downloads
