Abstract

This article investigates the role of precedent and interlocutory appeal in Brazilian Law and, then, combining both institutes, analyze the Theme 988 of the STJ to according social function of precedents and the historical evolution of the offense. Theoretical inconsistencies behind the decision under discussion are pointed out, based on the constitutional and infra-constitutional values that surround contemporary procedural science. It is concluded, at the end, that the thesis signed on Theme 988 of the STJ needs to be overcome.
