Abstract

The objective proposed in this article is to demonstrate that the judicialization of the collective resettlement of Gesteira, MG, a village affected by the collapse of the Fundão dam, should have been processed in line with the structural process. After analyzing the case, we concluded that the judicialization failed to observe the application of this useful theory and ended up not solving the retrospective problems, related to integral repair, and, mainly, those prospects that could restructure an entire mining system, which does not pay attention to the limits of environmental protection and human rights, but it drags and destroys them as well as the sludge of tailings.
