Abstract

The essay addresses the theory of process abuse for arbitration in the prearbitral phase. The text is divided into four parts. In the first, the theory of process abuse and how it is applicable to arbitration is exposed. The second part analyzes arbitration as a legal business. The third part will address the arbitration phases and the most recurrent abusive behaviors in the pre-arbitral phase. In the last part, the consequences of these acts will be analyzed.
