Abstract

The way of proceeding with the collation has been the object of successive alterations by the civil and civil procedural legislation. Currently, while the 2002 Braziliann Civil Code provides as a rule the collation by estimation, by the value assigned at the time of the liberality, the 2015 Brazilian Code of Civil Procedure establishes as a rule the collation by substance and, alternatively, by estimation by the value at the time of death. In this scenario, this article, which employs bibliographical and jurisprudential research as methodological procedures, aims to identify what would be the solution to the legal antinomy between the Civil Code and the Code of Civil Procedure. After surveying the bibliographical and jurisprudential material located, a lack of uniformity about the solution for the theme was verified. In the end, from the critical analysis of the positions, the use of the chronological criterion of solution of antinomies was adopted, so that it would prevail what the 2015 Code of Civil Procedure provides and, thus, the collation by substance or, only if no longer owning the property, by value of the property at death.
