Abstract

It is possible to extract authorization from the procedural system about the application of enforcement measures against nonparties as a result of the duties imputed to all without distinction, of being subject to the effects of the decision and of the general effective power structured in CPC/15. This reality had already been verified by an important written work by Sérgio Cruz Arenhart at the beginning of the last century, trend that was reinvigorated with the current procedural law. In contrast, no one can be harmed without due processo of law, so participation in an adversarial process is elementary for what is being analyzed.
