Resumo
A Constituição Federal apontou dois impostos que incidem sobre a propriedade imobiliária: o ITR - Imposto sobre a propriedade territorial rural e o IPTU – Imposto sobre a propriedade predial e territorial urbana. O primeiro é de competência da União Federal, e o segundo, dos Municípios. Esta competência é determinada pelo critério topográfico apontado pela Constituição Federal: o zoneamento urbano ou rural. No entanto, diversas legislações federais referentes ao ITR apresentaram a definição de imóvel rural, acrescentando o critério de destinação econômica da propriedade ao topográfico. O Código Tributário Nacional adota o critério topográfico. A doutrina, igualmente, não possui entendimento unânime, e a jurisprudência apresentou oscilações em seus julgados. Recentemente, a Administração Fazendária se pronunciou em decisão de solução de consulta, trazendo à baila a matéria. Diante deste quadro, debruçamo-nos sobre a problemática existente a fim de respondermos a estas questões: qual a via legislativa competente a trazer tais definições? Qual o critério a ser adotado? Como atender à segurança jurídica? Nossa análise tem como embasamento a Constituição Federal, as normas gerais de direito tributário e os princípios presentes no sistema, quais vetores a direcionar a interpretação e a aplicação do direito. Diante do confronto apresentamos uma solução jurídica.

Abstract
The Federal Constitution has appointed two taxes assessed on real estate: the rural real estate property tax (ITR) and the urban land and building tax (IPTU). The first is a tax of the competence of the Federal Union and the second is a tax of the competence of the Municipalities. Such competence is established by means of topographic criteria appointed by the Federal Constitution: the urban or rural zoning. However, several federal laws ruling the ITR present the definition of rural property adding to the topographic criteria the economic destination of the land. The National Tax Code adopts the topographic criteria. The doctrine has also yet to establish a unanimous understanding and the jurisprudence has shown variations on its decisions. Recently, the Tax Authorities have manifested their understanding by means of an Answer to an Advance Tax Ruling analyzing the subject. In this context, we ask ourselves the following questions: what is the competent legislative way to rule those definitions? How to comply with the legal certainty principle? Our analysis is grounded on the Federal Constitution, general rules of taxation and principles of the system, the vectors to guide the interpretation and application on the law. In face of the confrontation, a legal solution is presented.
