Resumo
A presente pesquisa tem por objetivo apresentar o instituto da expropriação social, trazido pelo art. 1.228, § 4º e § 5º do Código Civil de 2002, analisando seus requisitos e conceitos que devem ser cumpridos pelos possuidores a fim de que adquiram a propriedade do imóvel que ocupam irregularmente. Assim, como fundamento da aplicação deste dispositivo, apresenta-se a função social da posse e da propriedade, dos aspectos que envolvem as questões habitacionais nos loteamentos e assentamentos urbanos irregulares. Nesta trajetória, apresenta-se uma evolução histórica da moradia no Brasil, bem como das leis que regulamentaram ou ainda regulamentam a situação habitacional no país. Apresenta-se, ainda, a questão de contraponto do direito de propriedade com o direito à moradia e as formas mais tradicionais para efetivação do direito fundamental à moradia digna do mínimo existencial. Ao final, discute-se sobre a responsabilidade pelo pagamento da justa indenização prevista no § 5º do artigo em foco e da participação do Poder Público e Ministério Público nas lides que envolvem discussão acerca da expropriação social como meio de efetivação da dignidade da pessoa humana por meio da moradia adequada.

Abstract
This research aims to present the institute of social expropriation, brought by art. 1228, § 4 and § 5 of the Civil Code of 2002, analyzing your requirements and concepts that must be met by the owners in order to acquiring ownership of the property they occupy illegally. Thus, as the basis for application of this device, shows the social function of ownership and property, the aspects concerning housing issues in irregular settlements and urban settlements. In this trajectory, presents a historical evolution of housing in Brazil, as well as the laws that regulated or regulate the housing situation in the country. It presents also the question of counterpoint of property rights with the right to housing and more traditional forms for realization of the fundamental right to adequate housing as existential minimum. Finally, we discuss about the responsibility for paying the fair compensation provided for in § 5 of the article at issue and the participation of the government and prosecutors in chores that involve discussion of social expropriation as a means of realization of human dignity by middle of the adequate housing.
