Abstract

The legal framework of environmental protection require special attention to ecologically relevant goods and recognized by Constitution as Brazilian national patrimony. However, it is necessary to understand them as linked to special conflicts, intergenerational conflicts related to environmental heritage. The building of a positive intergenerational environmental heritage require a critical reading of citizenship. In this context, the paper takes the critical and propositional method, by the way of normative reconstruction, for handle with environmental conflicts. The general objective is the development of a concrete proposition of the application of intergenerational citizenship concept. The specific objective is to applicate intergenerational citizenship concept in the understanding of the Mata Atlântica Biome law framework. In this point of view, the protection of Biome is a local, regional and federal task. The coordination of local, regional and federal actions only can be achieved by the ecological federalism principle. The environmental rules assume different forms of constitutional protection execution, with emphasis on compliance and enforcement rules and regulations. Mata Atlântica become understanding as intergenerational patrimony, as intergenerational heritage. The suppression of vegetation require analysis of public power role in the environmental impact assessment, specially, regarding urban territorial space.
