O artigo estuda o surgimento do sistema "método do caso", difundido em grande variedade de áreas científicas, e, particularmente, no Direito, relacionando-o também com metodologias similares utilizadas desde há muito tempo. O trabalho estuda o case method na Harvard Business School e, antes, na Escola de Direito dessa Universidade. A seguir, passa-se em revista os casos como centro do espírito do Direito Romano e a utilização dos casos no ensino do Direito na Europa renascentista e na América Indiana. A seguir, volta-se às origens destes sistemas de ensino – rastreados na dialética grega e no método socrático – e ao seu eco na metodologia do debate, própria das universidades medievais. Termina com cinco conclusões, que demonstram que, ao se esquadrinhar a estirpe desta metodologia, se descobre a enorme riqueza de suas fontes antigas e medievais e de suas aplicações. Desse modo, põe-se de manifesto o erro no qual incorrem aqueles que mantêm uma atitude cética ou distante com relação ao método do caso no ensino do Direito, por entender que as suas origens são as de um método para ensinar a direção de empresas, o que o faria pouco apto às ciências mais dogmáticas, como o Direito; ou, então, que é um método próprio do mundo jurídico anglo-saxão, sendo tributário do entorno de onde nasceu e útil tão-somente no common law. Pelo contrário, pode ser um método altamente fecundo no nosso sistema continental de Direito.

Abstract
The article studies the beginning and the precedents of the pedagogical system called "case method", disseminated through a wide range of scientific areas and in Law particularly; relating it, also, to similar methodologies in use since long ago. The work studies case method at Harvard Business School and, earlier, at the university's Law School. Next, it conducts a review of law cases as the core of Roman Law, their usage at Law teaching in Renaissance Europe and lndian America, and the casuism in the study of MoraI Theology. Then, it turns to the origin of those teaching systems based upon Greek dialectics and the Socratic method and their echoe in the methodology of debate pertaining to mediaeval universities. It ends with five conclusions that show that, going over the lineage of this methodology, one realises the enormous richness of its ancient and mediaeval sources and their application. This way, it brings out into the open the error committed by those who take up a skeptical or detached stance towards case method in Law teaching, either for seeing its origins as those of a method to teach business management, which renders it unfit for more dogmatic sciences, such as Law; or for considering it specific of the Anglo-Saxon legal world, bound up with the environment where it came to life, and useful in common law alone. On the contrary, it can be a highly fruitful method in our continental law system.
