Abstract

Objective: this paper aims to examine the children and adolescents’ right to take part in family mediation sessions, expressing their views, wishes and concerns in hearings in which decisions can be taken that directly or indirectly affect their interests.

Method: the  research is based on a theoretical approach, using the deductive method, based on a bibliographical survey, through comparative analysis of specialized doctrine on the topic, scientific articles, jurisprudence and national and foreign legislation.

Results and conclusions: at the end, it's concluded that, through the adoption of certain prior precautions, it's fully feasible and recommendable, and, beyond that, necessary, the participation of children and adolescents in family mediation hearings, extrajudicial or judicial, pre-procedural or procedural, so that they can exert their right to be heard and to freely express their opinions on all matters related to them and to have their opinion truly taken into account in decision-making, even if consensual, as well as in the conclusion of any agreements reached between the parties.
