Between the duty to enforce and the practice of violating rights: the role of the state from the perspective of adolescents detained at case Mossoró/RN

Abstract

This article analyzes the role of the State in enforcing rights from the perspective of adolescents undergoing a socio-educational measure of hospitalization at the Centro de Atendimento Socioeducativo Mossoró/RN (CASE). In the first part of the work, which has a bibliographic and documentary approach, we study the normative provision of adolescents' rights, citing international and national normative documents. The second part of the article is empirical in nature, in which we investigate, based on 10 reports from adolescents hospitalized at the Centro de Atendimento Socioeducativo Mossoró/RN (CASE), the rights violations committed by the State against adolescents in vulnerable situations. This information is part of the database of the Human Rights in Practice Extension Project, of the Universidade Federal Rural do Semi-Árido (UFERSA). When comparing international and national standards with the reports of socio-educational students hospitalized at CASE Mossoró/RN, it was possible to conclude that there is a disparity between the normative prediction and the reality experienced by adolescents, both in the hospitalization unit and in their respective communities, leaving them violated their fundamental rights by the State, omissively and/or commissively.
