O direito ocupa lugar central na teoria da justiça social de Honneth. Em Luta por Reconhecimento (1992) ele é o padrão normativo concernente à universalização de direitos subjetivos fundamentais; em O Direito da Liberdade (2011), ele é considerado não apenas sob o prisma da legitimidade dos direitos subjetivos, mas do ponto de vista de seus limites e deficiências: a tese central é que o direito pensado em seu nível meramente negativo enquanto proteção legal de direitos individuais incorre em patologias sociais e na deterioração das relações éticas de reconhecimento mútuo.

Abstract: The Right occupies a central place in Honneth's theory of social justice. In Struggle for Recognition (1992) it is the normative standard concerning the universalization of fundamental subjective rights; in Freedom’s Right, it is considered not only from the point of view of the legitimacy of subjective rights but from the point of view of its limits and deficiencies: the central thesis is that Right thought at its merely negative level as legal protection of individual rights incurs social pathologies and the deterioration of ethical relations of mutual recognition.
