A teoria neoconstitucional do direito trouxe mudanças paradigmáticas na eficácia das normas constitucionais, seja pela capacidade científica de atribuir força normativa aos princípios jurídicos, seja pela superação do positivismo jurídico de aplicação mecânica do direito. Com efeito, o paradigma positivista não reconhecia o caráter normativo dos princípios constitucionais, considerando-os meras normas programáticas sem latitude normativa para assegurar direitos subjetivos. É por isso que o presente artigo propõe novas modalidades da eficácia constitucional a partir de uma “estrutura normativa tridimensional”, composta de uma área nuclear (área de conteúdo essencial da norma constitucional), uma área de ponderação de valores (zona de conflito com outras normas constitucionais de mesma hierarquia) e, finalmente, uma área metajurisdicional (domínio de eficácia meramente negativa, sem criação jurisprudencial do direito).Downloads
