Tendo em vista situações concretas que colocam desafios materialistas à teoria do direito, apresentamos e discutimos questões que fundamentalmente afetam a compreensão do fenômeno jurídico, a partir de uma formulação-teste: a forma-jurídica tem configurado os aspectos da nossa existência a partir de certas imagens do espaço que tendem a forjar – de forma acoplada, historicamente, à inflexão da economicização de todas as esferas da vida – a compreensão do jurídico como algo unitário e não ubíquo, difuso e disputado socialmente. O trabalho está estruturado em três espaços-tempo. Primeiro, discutimos a co-constituição entre direito e espaço nas linhas que aproximam teoria jurídica crítica e as teorias da produção da espacialidade. Em seguida, apresentamos o giro espacial das abordagens jurídicas, nos caminhos que vêm sendo construídos pela Geografia Jurídica Crítica para então apostar em uma teoria do direito “sem vestes”, discutindo os compromissos principais e as vantagens epistêmicas do materialismo jurídico-espacial. Ao final, aproximamos esses espaços-tempos a abordagens atuais do campo teórico brasileiro.

Abstract

 This paper presents and discusses issues that fundamentally affect the understanding of the legal phenomenon, given concrete situations that pose materialistic challenges to the Legal Theory, from a test-formulation: the legal-form has shaped aspects of our existence from certain images of space that tend to forge - historically coupled with the inflection of economization in all spheres of life - the understanding of the legal as something unitary and not ubiquitous, diffused and socially disputed. The work is structured in three spacetime. First, we discuss the co-constitution between law and space along the lines that bring together Critical Legal Theory and theories of spatial production. Then we present the spatial turn in law, in the ways that have been constructed by the Critical Legal Geography, to then propose a “disrobed theory”, discussing the main commitments and the epistemic advantages of the legal-spatial materialism. In the end, these spacetimes are approximated to current approaches of the Brazilian theoretical field.
