Abstract

In this article, the author aims to discuss issues related to the accusatorial procedure in the criminal justice system. In addition to that, the paper highlights the principal points on the behalf of the construction of a theory of the case, which should have as reference the classification of the fact. Based on this, it will be analyzed the need for correspondence between the fact that occurred and the fact effectively proved to avoid different interpretations regarding the same fact.
