Abstract

The article presents the analysis of the reasonsrequired to answer the question whether there is harmfulness in the coexistence between individual and collective claims. Contextually, the reflection is necessary because it is under deliberative discussion in parliament, on the same theme, the PLS 1.641/2021. The objective of this paper is to analyze and understand the main reasons that indicate, in response to the problem hypothesis, the existential compatibility between individual and collective claims. In order to reach a positive answer to the question, it is examined, through dogmatic or instrumental research, in specific topics, the treatment of the theme from two theoretical references: a) the current jurisprudence of the Superior Court of Justice on the proposed theme, while Supreme Court of our judicial system; and, b) its current regulation proposed in the Substitute Law Project 1.641/2021 (which intends to discipline and standardize the collective and structural process).
