PARTIAL EARLY JUDGMENT OF THE MERIT: CONSIDERATIONS IN THE LIGHT OF THE FUNCTIONAL POWER OF PROCEDURAL MANAGEMENT

The nature of partial early judgment on the merits, whether the magistrate's duty or his faculty, has been debated by the doctrine, as was, at the time of CPC/1973, the nature of the early judgment of the dispute. In this article, it is argued that this discussion is put in the wrong terms, since the judge does not have pure faculties, but functional powers, and it must be analyzed which margin of discretion linked to the legal order is attributed to the exercise of such power. . It is indicated that the functional power of procedural management is relevant to answer this question, and serves to delimit the hypotheses in which there should or should not be a partial advance judgment of the merits due to considerations related to its functional aspects. Such understanding is demonstrated through the proposition of six criteria arising from the procedural management, which are relevant to assess the fulfillment of the functional presupposition of the institute of partial advance judgment of the merits.Published
