Abstract

The article aims to analyze, within the scope of the Brazilian legal system, the feasibility of filing child support accountability actions under family law, considering that there is a settled jurisprudence in the STJ regarding its impossibility and a recent precedent admitting it, enacted by one of its Panels. Through the inductive method, by means of the res judicata analysis, elements were embedded that justify the continuation of the controversy in the Court, and the need for a solution, as soon as possible, especially in light of the personality rights of the parties involved and judicial security.
