Abstract

This article deals with Chaïm Perelman's theory of argumentation and its fundamental principles, to demonstrate its influence in the contemporary legal field. Using the deductive method, in a diversified bibliographic research, aiming to carry out a comparative study between Perelman's theory, the wording of article 489 of the Brazilian Civil Procedure Code and the decisions of the Superior Courts. The objective was to demonstrate that the jurisdictional bodies do not adequately justify their judicial decisions, not allowing the parties to materialize what Perelman called adhesion and, consequently, prevent the real adversary, based on the Democratic Rule of Law.
