Resumo
O artigo apresenta a discussão jurisprudencial, que se insere nos campos do direito constitucional e do direito urbanístico, sobre a aplicação das leis municipais que não observem restrições convencionais de uso do solo urbano anteriores, instituídas por loteador privado. A discussão é se as convenções de loteamento gerariam, para cada proprietário, direito adquirido de efeitos gerais, oponível ao próprio legislador municipal. Com base na Constituição e nas normas gerais federais, o estudo conclui que não existe direito adquirido individual quanto ao estatuto jurídico geral da propriedade de terceiros, cuja definição é de competência pública, sendo matéria reservada à lei. Os imóveis urbanos estão sujeitos ao cumprimento da função social assinalada pelas leis urbanísticas municipais, que redefinem periodicamente os usos a que estão destinados. Restrições convencionais quanto ao uso dos lotes são apenas supletivas; elas se aplicam se, e enquanto, não existirem regras próprias na legislação municipal. Quando justificável como política urbana, a preservação do patrimônio cultural ou ambiental associado ao loteamento tem instrumentos adequados, como as regras específicas do plano diretor e, em casos especiais, o tombamento.

Abstract
The article presents the jurisprudential discussion, that falls within the field of constitutional and urban law, about the application of municipal laws that do not observe previous conventional restrictions of the use of urban soil, instituted by a private agreement. The discussion is if soil subdivision conventions would generate, for each owner, an acquired right of general effects, opposable to the municipal legislator. Based on the Brazilian Federal Constitution and general federal regulations, the study concludes that there is not an acquired individual right, founded in a private agreement, that can prevail over a supervening public norm. Urban real estate is subject to the social function fulfillment signaled by municipal urbanistic laws, that periodically redefine the uses for which they are destined. Conventional private restrictions about the use of soil are only supplementary; they apply if, and while, there are no specific rules in municipal legislation. When justifiable as an urban policy, the preservation of cultural or environmental heritage associated with the soil subdivision has adequate instruments, such as specific rules of zoning ordinance and, in special cases, the preservation of patrimony by an administrative act.
