O direito à moradia e as ocupações ilegais / The right to housing and illegal occupations

Resumo
Esta pesquisa abordará o tema do Direito à moradia e as ocupações ilegais. Para fins de pesquisa, este trabalho, baseou-se na pesquisa bibliográfica, analisando a doutrina, para assim elucidar a inevitável questão: O Direito social e fundamental à moradia legitima a ação de movimentos sociais por habitação utilizando meios ilegais de apropriação? Nesse contexto, serão estudados conceitos basilares do direito fundamental e social à moradia, alguns fatores do direito de propriedade, dentre eles, a sua função social. Que aferirá se na prática, a lei tem claro a função jurídica do estado em relação à defesa do Direito de propriedade frente aos meios de efetivar o Direito à moradia.

Abstract
This research will address the theme of the Right to housing, not legitimizing disordered invasions. For the purpose of research, this work was based on bibliographical research, analyzing the doctrine, in order to elucidate the inevitable question: Does social and fundamental right to housing legitimize the action of social movements by housing using illegal means of appropriation? In this context, fundamental concepts of the fundamental and social right to housing will be studied, some factors of property rights, among them, their social function. Which will verify if in practice, the law has clear the legal function of the state in relation to the defense of the Right of property in relation to the means to effect the Right to housing.
