Reumo
A diferenciação do bem comum, de uso de todos, dos bens privados, que são garantidos pela Carta Magna assegura que cada um cumpra sua função social. A problemática repousa quando o interesse privado e o poderio econômico se sobrepõem no lugar do público e da coletividade prejudicando a sociedade em face do interesse de poucos. Assim, o artigo analisa a maneira pela qual a intervenção imobiliária pode afetar o zoneamento de uma área e causar a transmutação de um bem comum em privado. Para tanto, o estudo visa apresentar os aspectos jurídicos controversos sobre a construção do residencial instalado na Praia do Paiva, no Cabo de Santo Agostinho/PE. A investigação se deu de maneira exploratória por meio de pesquisa bibliográfica. Ao fim, verificou-se diversas controvérsias quanto a forma que o município se adaptou para receber o empreendimento e como isso impactou ao acesso à praia e a cultura local.

Abstract
The differentiation of the common good, of use of all, of the private goods, which are guaranteed by the Magna Carta guarantees that each one fulfills its social function. The problem rests when private interest and economic power are subjugated in the place of the public and the community, damaging society in the face of the interest of the few. Thus, the study analyzes the way in which real estate intervention can affect the zoning of an area and cause the transmutation of a common good in private. Therefore, the research aims to present the controversial legal aspects on the construction of the residential building in Praia do Paiva, in Cabo de Santo Agostinho / PE. The research was done in an exploratory way through bibliographic research. At the end, there were several controversies about the way the municipality adapted to receive the project and how it impacted access to the beach and local culture.
