O aluguel social como instrumento perene de dignificação da pessoa humana / Social rental as perene instrument of dignification of the human person

Resumo

Propõe análise de matéria afeita à promoção do direito à moradia, em áreas de risco, associada às consequências das grandes enchentes (catástrofes). O fenômeno da derrubada de encostas e construções residenciais, com o desalijo de famílias, acrescido à inércia do Poder Público na implementação de efetivas políticas públicas habitacionais e/ou na minimização dos reflexos negativos, quando das fortes chuvas que vitimaram regiões metropolitanas, são abordados a partir da omissão específica do Poder Público. Nesse contexto, procede-se ao exame de decisões judiciais, proferidas no âmbito do Tribunal de Justiça do Estado do Rio de Janeiro, sobre o benefício do aluguel social, em cotejo com as respectivas regulamentações.

Abstract

An analysis is proposed regarding the promotion of housing rights in risk areas, associated with the consequences of large floods (catastrophes). Landslides and the collapse of residential buildings, leaving families homeless, combined with the inertia of the Public Authorities in the implementation of effective public housing policies and/or the minimization of negative outcomes when heavy rainfall affects metropolitan regions are addressed in terms of the specific omission of the authorities. In this context, legal decisions are examined, which were made by the Justice Tribunal of Rio de Janeiro State, with regard to the benefits of social rent and the respective regulations.
