Uma análise sobre a pobreza a partir da justificação moral dos direitos humanos pela teoria das necessidades básicas / An analysis of poverty from the moral justification of human rights by thetheory of basic needs

RESUMO: Este texto tem como propósito demonstrar que a teoria das necessidadeshumanas básicas é um instrumento adequado para a compreensão da pobreza a partir daperspectiva institucional dos direitos humanos. Assim, inicialmente verifica-se algunsaspectos relacionados com a conceituação dos direitos humanos, nos planos moral elegal. Em seguida, é desenvolvida uma abordagem sobre a justificação moral dos direitoshumanos a partir da identificação de uma série de necessidades básicas comuns a todasas pessoas; continuando, discute-se a questão dos direitos humanos como sendo canaisde atendimento das necessidades básicas. Por último, apresenta-se uma contextualizaçãoda pobreza sob a ótica institucional, no âmbito nacional e internacional; para, então, fazeruma explanação sobre as perspectivas teóricas, para a análise da pobreza e dasnecessidades básicas, propostas Amartya Sen e John Rawls. O método de procedimentoutilizado foi o descritivo-analítico, tendo sido realizadas abordagens por meio de consultasà textos jurídicos, nacionais e internacionais, bem como usamos bibliografias inerentesaos campos da filosofia moral e da ciência política, sempre buscando nortear os eixostemáticos deste estudo. Ao final, concluiu-se que o esforço para erradicar a pobrezarequer o conhecimento das causas e dos fatores econômicos que a produzem e a fazemaumentar, bem como pressupõe a compreensão dos mecanismos jurídicos, políticos einstitucionais relacionados com a proteção dos direitos humanos fundamentais. Dessemodo, compreendemos que a luta contra a pobreza é um desafio social, ético, político e,sobretudo, jurídico, que questiona o Estado e seu papel, como também o Direito, em seusfundamentos e práticas, que são na época atual reconhecidos como base da dignidadehumana; em outras palavras, a existência da pobreza é um convite para uma reflexãogeneralizada sobre o sentido dos direitos humanos, em suas exigibilidade e efetividade.

ABSTRACT : This paper aims to demonstrate that the theory of basic human needs is an adequateinstrument for understanding poverty from the perspective of institutional human rights.So, initially it appears some aspects related to the concept of human rights, in the moraland legal plans. Then an approach to moral justification of human rights from theidentification of a number of basic needs common to all people is developed; continuing,we discuss the issue of human rights as being the basic needs channels attendance.Finally, we present a context of poverty from the institutional perspective, nationally andinternationally, to, then make an explanation of the theoretical perspectives for theanalysis of poverty and basic needs, proposed by Amartya Sen and John Rawls. Themethod of procedure used was descriptive-analytical; approaches have been madethrough consultation with legal, national and international texts and use bibliographiesrelating to the fields of moral philosophy and political science, always seeking the guidingthemes of this study. At the end, it was concluded that the effort to eradicate povertyrequires knowledge of the causes and economic factors that produce and do increase, andassumes an understanding of related legal, policy and institutional mechanisms with theprotection of fundamental human rights. In this way, we understand that the fight againstpoverty is one, ethical, political and especially social legal challenge questioning the stateand its role, as well as the law, in its fundamentals and practices, which are recognized inthe current period as basis of human dignity, in other words, the existence of poverty is acall for a general reflection on the meaning of human rights in their chargeability andeffectiveness.
